Terms of Service

1. Acceptance of Terms

By accessing or using aiio (the “Platform”), operated by aiio (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Platform.

Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Eligibility

You must be at least 13 years of age to use the Platform. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Platform with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the Platform, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate accounts that we reasonably believe violate these age requirements.

3. Account Registration

To access certain features, you must create an account. You may register using an email address and password, or through third-party authentication providers (Google, Twitter/X). You are responsible for:

• Providing accurate and complete registration information;
• Maintaining the confidentiality of your account credentials;
• All activities that occur under your account;
• Notifying us immediately of any unauthorized use of your account.

You may not create multiple accounts, share your account with others, or transfer your account without our prior written consent.

4. Services Description

aiio provides the following services:

• AI Art Generation: Create images using multiple AI engines. Each generation consumes coins based on the engine and parameters selected.
• Social Features: Publish artworks, follow other users, like, comment on, and bookmark content.
• Coin Economy: An in-platform virtual currency (“Coins”) used to pay for AI generations and premium features.
• Subscriptions: Monthly or annual subscription plans providing additional benefits such as increased coin allocations and premium engine access.

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.

5. Content Ownership & Licenses

5.1 Paid Users

If you generated content using paid coins (purchased or earned through a subscription), you retain full usage rights to that content, subject to the limitations described in Section 8. You may use such content for personal and commercial purposes.

5.2 Free Users

Content generated using free coins or promotional credits is granted to you for personal, non-commercial use only. You grant aiio a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, and display such content for any purpose, including but not limited to platform promotion and marketing.

5.3 Published Content

By publishing any content on the Platform (including artworks, comments, and profile information), you grant aiio a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content in connection with the Platform and its marketing. This license continues until you remove the content from the Platform, after which it terminates within a commercially reasonable period, except where the content has been shared by other users or is required for legal compliance.

6. Prohibited Content & Conduct

You agree not to use the Platform to generate, upload, publish, or distribute content that:

• Depicts the sexual exploitation or abuse of minors in any form;
• Contains non-consensual intimate imagery or deepfakes of real individuals;
• Constitutes illegal content under applicable law, including but not limited to content that promotes terrorism, violence, or illegal drug use;
• Infringes upon the intellectual property rights, privacy, or publicity rights of any third party;
• Contains malware, spam, or deceptive content;
• Attempts to circumvent our content moderation systems.

We employ AI-powered content moderation. Content that violates these rules will be removed, and your account may be suspended or terminated. You are solely responsible for ensuring that your use of generated content complies with all applicable laws in your jurisdiction.

7. Payments, Coins & Subscriptions

7.1 Coins

Coins are a virtual currency with no monetary value outside the Platform. Purchased coins are non-refundable and non-transferable. Coins may not be exchanged for cash or any other form of compensation. Unused coins do not expire unless your account is terminated for violation of these Terms.

7.2 Subscriptions

Subscriptions are billed in advance on a recurring basis (monthly or annually) through Stripe. Subscriptions are non-refundable for the current billing period. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. We reserve the right to modify subscription pricing with 30 days’ prior notice.

7.3 Failed Generations

If an AI generation fails due to a system error, the coins consumed for that generation will be automatically refunded to your account. This is the sole remedy for failed generations.

8. AI-Generated Content Disclaimer

You acknowledge and agree that:

• AI-generated content may not be eligible for copyright protection under the laws of many jurisdictions. The legal status of AI-generated works is evolving and varies by jurisdiction.
• We make no representations or warranties regarding the copyrightability, originality, or legal protectability of any AI-generated content.
• AI-generated content is provided on an “as-is” basis. Results may vary in quality, accuracy, and appropriateness.
• You are solely responsible for reviewing AI-generated content before use, and for ensuring that your use complies with all applicable laws.
• You assume all risk associated with the commercial use of AI-generated content, including potential intellectual property claims by third parties.

9. Intellectual Property

The Platform, including its design, code, logos, trademarks, and all non-user-generated content, is the intellectual property of aiio and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.

“aiio” and the aiio logo are trademarks of aiio. You may not use our trademarks without prior written permission.

10. Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to the Platform, other users, or third parties. Upon termination:

• Your right to use the Platform ceases immediately;
• Any unused coins in your account are forfeited;
• Active subscriptions will not be refunded for the current billing period;
• We may delete your account data after a reasonable retention period, subject to legal requirements.

You may delete your account at any time through your account settings.

11. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the quality, accuracy, or reliability of any AI-generated content.

12. Limitation of Liability

To the maximum extent permitted by applicable law, aiio and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Platform, regardless of the theory of liability.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the amounts you have paid to us in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD $100).

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email to your registered address. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform.
